Privacy Policy
Public Offer. Privacy of Personal Data. This Privacy Policy (hereinafter referred to as the Privacy Policy) applies to all information that the Allur website, located at the Allur.kz domain name, may receive about the user while using the online store website, programs, and products.
1. DEFINITION OF TERMS
1.1 The following terms are used in this Privacy Policy:
1.1.1. "Website Administration" (hereinafter referred to as the Website Administration) – authorized employees to manage the website, acting on behalf of Allur Auto LLP, who organize and/or process personal data, and determine the purposes of personal data processing, the scope of personal data to be processed, and the actions (operations) performed with personal data.
1.1.2. "Personal data" – any information relating to a directly or indirectly identified or identifiable individual (personal data subject).
1.1.3. "Personal data processing" means any action (operation) or set of actions (operations) performed with or without the use of automated tools with personal data, including the collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.
1.1.4. "Confidentiality of personal data" means the mandatory requirement for the Operator or another person who has gained access to personal data to prevent their dissemination without the consent of the personal data subject or other legal grounds.
1.1.5. "User of the Online Store Website (hereinafter referred to as the User)" means a person who has access to the website via the Internet and uses the website.
1.1.6. "Cookies" are small pieces of data sent by a web server and stored on the user's computer. A web client or web browser sends these cookies to the web server in an HTTP request each time it attempts to open a page on the corresponding website.
1.1.7. "IP address" is the unique network address of a node in a computer network built using the IP protocol.
2. GENERAL PROVISIONS
2.1. By using the Online Store website, the User agrees to this Privacy Policy and the terms of processing the User's personal data.
2.2. If the User disagrees with the terms of the Privacy Policy, they must stop using the Online Store website.
2.3. This Privacy Policy applies only to the "Allur" website. The Online Store does not control and is not responsible for third-party websites that the User may access via links available on the website.
2.4. The Website Administration does not verify the veracity of the personal data provided by the User to the Online Store website.
3. SUBJECT OF PRIVACY POLICY
3.1. This Privacy Policy sets forth the obligations of the Website Administration to maintain confidentiality and ensure the protection of the privacy of personal data that the User provides at the request of the Website Administration upon registration on the online store website or when placing an order for a product.
3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by completing the registration form on the Allur online store website in the Ordering or Registration sections and includes the following information:
3.2.1. The User's IIN, last name, first name, and patronymic;
3.2.2. The User's contact phone number;
3.2.3. Email address;
3.2.4. Delivery address;
3.2.5. The User's place of residence.
3.3. The online store protects data that is automatically transmitted while viewing ads and visiting pages with a statistical system script ("pixel") installed: IP address; cookie information; browser information (or other program that accesses ad displays); access time; address of the page on which the ad is located; referrer (address of the previous page).
3.3.1. Disabling cookies may result in inability to access parts of the online store website that require authorization.
3.3.2. The online store collects statistics on the IP addresses of its visitors. This information is used to identify and resolve technical issues and to verify the legitimacy of financial transactions.
3.4. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) will be securely stored and will not be distributed, except as provided in paragraphs 5.2 and 5.3 of this Privacy Policy.
4. PURPOSES OF COLLECTING THE USER'S PERSONAL INFORMATION
4.1. The Online Store Website Administration may use the User's personal data for the following purposes:
4.1.1. Identifying the User registered on the Online Store website to place an order and/or conclude a Remote Sale and Purchase Agreement with "allur.kz."
4.1.2. Providing the User with access to the personalized resources of the Online Store website.
4.1.3. Establishing feedback with the User, including sending notifications and requests regarding the use of the Online Store website, provision of services, and processing requests and applications from the User.
4.1.4. Determining the User's location to ensure security and prevent fraud.
4.1.5. Confirming the accuracy and completeness of the personal data provided by the User.
4.1.6. Creating an account to make purchases if the User has consented to the account creation.
4.1.7. Notifying the User of the online store website about the order status.
4.1.8. Processing and receiving payments, confirming taxes or tax benefits, disputing payments, and determining the User's eligibility for a line of credit.
4.1.9. Providing the User with effective customer and technical support should problems arise related to the use of the online store website.
4.1.10. Providing the User, with their consent, with product updates, special offers, pricing information, newsletters, and other information on behalf of the online store or on behalf of the online store's partners.
4.1.11. Carrying out advertising activities with the User's consent.
4.1.12. Providing the User with access to the websites or services of the online store's partners for the purpose of obtaining products, updates, and services.
5. METHODS AND TERMS OF PERSONAL INFORMATION PROCESSING
5.1. The User's personal data may be processed indefinitely, by any legal means, including in personal data information systems, with or without the use of automated tools.
5.2. The User agrees that the Website Administration reserves the right to transfer personal data to third parties, in particular, courier services, postal companies, and telecommunications operators, solely for the purpose of fulfilling the User's order placed on the Allur online store website, including delivery of the goods.
5.3. The User's personal data may be transferred to authorized government bodies of the Republic of Kazakhstan only on the grounds and in the manner established by the legislation of the Republic of Kazakhstan.
5.4. In the event of loss or disclosure of personal data, the Website Administration will inform the User of the loss or disclosure of personal data.
5.5. The Website Administration takes the necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, and other illegal actions by third parties.
5.6. The Website Administration, in conjunction with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.
6. OBLIGATIONS OF THE PARTIES
6.1. The User is obligated to:
6.1.1. Provide the personal data necessary to use the online store website.
6.1.2. Update and supplement the personal data provided if this information changes.
6.2. The Website Administration is obligated to:
6.2.1. Use the information received solely for the purposes specified in Section 4 of this Privacy Policy.
6.2.2. Ensure that confidential information is kept confidential, not disclosed without the prior written consent of the User, and not sell, exchange, publish, or otherwise disclose the User's personal data transmitted, with the exception of Sections 5.2 and 5.3 of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedures generally used to protect such information in existing business practices.
6.2.4. Block personal data related to the relevant User from the moment of the User's request or appeal, or from their legal representative or authorized body for the protection of personal data subjects' rights, for the duration of the verification period, if inaccurate personal data or illegal actions are detected.
7. LIABILITY OF THE PARTIES
7.1. The Website Administration, if it fails to fulfill its obligations, is liable for damages incurred by the User due to the illegal use of personal data, in accordance with the legislation of the Republic of Kazakhstan, except for cases provided for in paragraphs 5.2, 5.3, and 7.2 of this Privacy Policy.
7.2. The Website Administration will not be liable for the loss or disclosure of confidential information if such confidential information:
7.2.1. Became publicly known prior to its loss or disclosure.
7.2.2. Was received from a third party prior to its receipt by the Website Administration.
7.2.3. Was disclosed with the User's consent.
8. DISPUTE RESOLUTION
8.1. Before filing a claim in court regarding disputes arising between the User of the Online Store website and the Website Administration, it is mandatory to submit a claim (a written proposal for a voluntary settlement of the dispute).
8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt of the claim, notify the claimant in writing of the results of the claim review.
8.3. If no agreement is reached, the dispute will be referred to a judicial authority in accordance with the current legislation of the Republic of Kazakhstan.
8.4. The current legislation of the Republic of Kazakhstan shall apply to this Privacy Policy and the relationship between the User and the Website Administration.
9. ADDITIONAL TERMS
9.1. The Website Administration reserves the right to make changes to this Privacy Policy without the consent of the User.
9.2. The new Privacy Policy takes effect from the moment it is posted on the Online Store Website, unless otherwise provided in the new version of the Privacy Policy.
